>> in the news this sun morning january 8th, at least six members of occupy oakland were arrested during an anti-police march last night in downtown oakland. and gop presidential candidates prepare for yet another debate this morning. just ten hours after facing off last night in a contentious debate. >> good morning, kind of windy in the upper elevations, but 40s and 50s at the surface. not as chilly but mice and mild again with sunshine this afternoon. >> thank you lisa. good morning, everyone. thanks nor joining us, i'm carolyn tyler. at least six occupy oakland protestors face charges this morning, including vandalism assaulting police officers and possessing explosives after an anti-police march last night. starting around 8:00 they

where the problems are in this country. >> as far as who californian republicans think will be the nominee, romney seems to have an unshakeable lead. bickering won't change that. >> i think romney kept his lead. i don't think anything dramatic happened to take the field away from him. until the field narrows down to maybe one or two anti-romneys, he will continue to lead. >> california republicans believe that romney has the inside track on the parties' nomination. they say after not if romney wins new hampshire and he also wins south carolina, then he's a shoe-in. abc7 news. well, let's turn to news back here at home in the east bay. investigators believe faulty smoke detectors may have led to a deadly fire in bay point. contra costa fire crews were called out to the valley oaks townhomes just before 5:00 yesterday morning. the fire chief said the body of a woman in her 60s was found in that building. the fire destroyed one unit and

damaged two nearby homes leaving five adults and four children homeless. in vacaville fire destroyed a home yesterday just as the owner was planning to move out. most of the family's belongings were already inside a moving container. while the owner and his family were away, the four-alarm fire burned the home and a moving con tanner to the ground. >> everything was in that 40-foot container that i moved out of that house. my whole lifely hood was in that house. my kids' rooms everything. i mean everything they have gotten for christmas all our personal livelihood was in that 40-foot container. and its burnt down to the ground now. >> well, no one, fortunately was injured. a san francisco family is homeless after a fire burned their two-story sunset district home last night. firefighters say the 35th avenue home is a total loss. investigators aren't sure exactly how it started around 9:00. it took only 15 minutes to put

it out. one person was home at the time and escaped without injury. the loss leaves the family of four looking for a new place to live. san francisco police have released the name of a suspect in three violent sexual assaults in the mission district. officers arrested 32-year-old fredrik dozer on friday. they say information from the department's anonymous tip line links him to evidence found at the scenes of the assaults. he was also captured on a video surveillance tape. he also faces charges of attempted murder and robbery. the race to find a bone marrow donor for a little boy is getting more serious. four-year-old kyle crawford missed his own donor drive yesterday because he had to be rushed to the emergency room. you see this line at serendipity school in san mateo yesterday. hundreds signed up for the bone marrow registry. kyle is battling aplasticanemia.

that means his bone marrow is not making enough new blood cells. >> and i'm just amazed at the amazing community we have. all we have is hope. >> kyle's mother is chinese, his father is caucasian, which means the 4-year-old most likely needs a bone marrow donor of multi-ethnic or asian an ses industry. another drive is next saturday at the hade ash bury clinic from noon to three. coming up, arizona prepares to remember the victims of last year's deadly mass shooting that left six people dead and congresswoman gabrielle gifford among the injured. and just as one problem with the new 49er stadium is solved there is new opposition.

[ crunching, sipping ] be happy. be healthy. can i try yours? >> this morning survivors of last year's deadly mass shooting in arizona mark a somber arizona. it was one year ago today a gunman opened fire at what was called a "congress on your corner" event outside a tucson grocery store hosted by congresswoman gabrielle gifford. six people were killed, 13 wounded. giffords is still recovering from a bullet wound to the head. to all of us. she's shown perseverance and strength, and i'm optimistic she'll be walking the halls of congress again in the near future. >> the congresswoman's husband said his wife is motivated to recover from her injuries and get back to work in washington hoping to use her inspirational

story to mend political differences in the nation's capital. a decision on a new 49ers stadium is coming down to the wire with a new group of citizens launching a hail mary campaign to try to block it. abc news 7 has the story from santa clara. >> just when it looked like the 49ers move to santa clara was a done deal, the opposition is coming out with a new strategy. >> we want to put it back up to vote because we are disputing the contract and the financing. volunteers with santa clara plays fair a group opposed to the stadium deal are gathering signatures. they need 6,000 signatures for a ballot measure to reject a city contract to develop the $1 billion 49ers stadium. last month the authority approved a plan to use a $850 million loan to fund the development. >> where do we sign? >> but a few feet away, stadium

supporters had their own message to get out. >> the taxes that will come from building the stadium and the job that it creates will go back into the community. >> members of ivew local 32 passed out flyers saying stop. think before you sign the pegs. labor unions need the stadium deal to go through for its member's survival. many are counting on the construction work. the union paid some unemployed members to pass out flyers against the referendum. >> it's just going to prolong what the voters have already voted for and what the stadium authorities already approved. >> that's the vote and we should stay with that vote. >> others disagree. >> because we think it's a too expensive project and we don't know what all the ramifications for the city's finances are going to be. >> i would say there's a little switcharoo going on. marijuana accuse the city of changing the terms of the deal after measure j was passed in

2010. the project will use no more than $40 million of the redevelopment money. rest will come from a hotel tax, the 49ers and the stadium lone. that loan in case of an emergency. if the signatures are gathered it could go back for a revote as soon as june. i spoke with a santa clara city spokesperson and she said city leaders welcome this effort and will honor the voters' decision. in santa clara, abc7 news. >> a california supreme court decision that allows the state to seize redevelopment money throws a wrench into plans to build the a's a new ballpark in oakland. today's oakland tribune reports the city is scrambling to replace redevelopment funds but might have helped build the proposed victory court ballpark. they are now looking at a federal program that allows immigrants to buy green cards for their family if they invest in projects that create at least ten full-time american jobs. the minimum investment is

$1 million, except for high unemployment areas where a half million dollars is required. the tribune says oakland mayor jean quan has been talking with chinese investors who are said to be very interested. lisa is here now with a review of the accuweather forecast. any rain there? >> well, there's hints of it once again. we do believe already in the 50s. san francisco, oakland, san jose. you notice how warm it was. we have a couple 30s up there up in the north bay. this camera looks pretty stable but we have some gusty winds in the upper elevations. so we are talking about a breezy start, but a different finish. i'll fill in the details coming up. >> thank you, lisa. also ahead an epic battle. stanford and oregon state going to four overtimes before they could decide who would make the winning basket. mike shumann has the highlights of the fantastic finish coming up in this morning's sports.

about 30% of normal oakland and san francisco. of course, we need the rain and a live look outside right now. the sun is up. it's 7:25. boy, we have some very mild temperatures to start out this sunday morning. that's due to some very gusty winds. you see the camera shaking a little bit here in the higher elevations above 1,000 feet. we are looking at 50s all around san francisco. oakland 57. 49 the temperature has dropped to in san jose but 54 half moon bay with a couple 30s from novato to santa rosa. really not a bad start out there. certainly not feeling like january. 56 in fremont, 40 in mountain view. here's view. we have a north wind gusting to 18 miles an hour mountain view the easterly winds. and easterly winds for concord and fairfield. above this we are talking 40 miles an hour wind gusts. the strong ridge has brought the jump start to the warming this morning is beginning to fade and

it will weaken this afternoon. this will be the last morning where we see the very mild temperatures and then we will look for some subtle changes. 15 degrees warmer this morning in concord. redwood city you are 7 degrees warmer. look at napa. out of the upper 20s for a change. feeling not too hard to take this morning and that's because of the breezy winds. sunny and mild today. still dry weather into next week. the best chance or the first chance of a significant change is tuesday with a weak system headed down from the north and then the models, of course, disagreeing on what's going to happen week's end. 60s will be widespread around the bay today. a little bit of a north wind could pop our numbers up to around 70. santa rosa also around the monterey bay. but we've got one area of high pressure beginning to slide into the sierra nevada. of course, this system not making any in roads because of the high off to the south of us. so we will look for another mild to warm day today. the relative humidity continues

to drop in the mountains. the winds are gusty so the two areas prone to the gusty winds the low relative humidity, the high fire danger will be the west slopes of the sierra nevada and from press no on southward. we are stuck in between with a very dry atmosphere. slightly breezy conditions. now the winds making their way all the way to the coast. we are looking 70s in big sur. enjoy it today we will see the changes tom. napa 64 and down by the monterey bay, a few more 70s today. nice and mild out there. gilroy 69. and the accuweather seven-day forecast starting out today with the mildest temperatures. a little cooler tomorrow with the on shore push and then a weak weather system bringing some upper 50s to our coast on tuesday. a slow recovery nothing dramatic. no big changes. we are still waiting for them. >> yeah. with the winds today and the dry conditions, that's -- >> yeah, they are going to subside by midday.

>> welcome back. it's inauguration day in san francisco where newly-elected leaders will be sworn into office in public ceremonies. the festivities begin at 10:00 this morning at city hall with multi-cultural music and dance performances. at 11:00 former mayor willie brown will serve as master of ceremonies, as mayor ed lee gets sworn into office by senator diane feinstein. a celebration with dance and musical performances will follow beneath the city hall rotunda. a cloud of legal questions hanger today owes swearing in. a former supervisor, ross mereremi as san francisco's sheriff. an ongoing investigation into a domestic violence investigation against him is being conducted. while that is not going to be decided before today's swearing in, the san francisco chronicle

reports a judge who agreed to conduct the oath of office has now recused herself to avoid any possible conflict should charges be filed. mererrimi and his wife both deny the accusation that came from a neighbor. tuesday officials in san francisco are expected to make a decision about a jack in the box restaurant. people living nearby don't want it to stay open late at night. things came to a head when one man was run down after getting into an argument with another man inside the restaurant. >> for years this jack in the box on geary boulevard has been open 24-7. >> you are open at night and hungry you can go to the jack in the box. >> but some neighbors in the surrounding residential area say this fast-food restaurant is a magnet for drunks and troublemakers, especially after the bars close at 2:00 a.m. >> we need to close this jack in the box between 2:00 a.m. and

4:00 a.m. to make sure that the neighbors have a chance for peace and quiet at night. >> david lee has started an on line petition to have the restaurant's hours restricted. more than 400 people have signed. many of them point to what happened early thanksgiving morning when, according to police, a fight inside the jack in the box escalated into an intentional hit-and-run at the gas station down the street. off-duty firefighter, albert remains in critical condition. that's when city hall learned the restaurant was operating around the clock without the proper permits. and critics are now seizing the opportunity to try to close it for two hours overnight. >> that would make a tremendous amount of difference. >> perhaps surprisingly it's the city's entertainment commission that has jurisdiction. >> the neighbors do have legitimate concern. the business also is zoned properly and has the right to do that kind of business at that location. >> a spokesperson for the restaurant's owner said he's hired a security guard.

he's trimmed overgrown landscaping and he's installed additional exterior lighting to ensure the safety of his guests and employees. but the district supervisor says they need to go even further. >> they think that a community plan with police jack-in-the-box taking more responsibility and neighbors being more organized, that's a better plan for safety in the neighborhood. there are over 120 businesses that have after-hour permits all around the city from doughnut shops to cafes. the kind of permit jack in the box one had and hopes to have again. tomorrow the marin county transportation authority will formally review plans to put toll lanes on highway 101. but today's marin independent journal reports the study shows high occupancy solo lanes where people pay a toll to use the lanes would not make it worthwhile. the authority were hoping the

cruz. the sun is about toroids. hope your new year's is getting off to a great start and thanks for spending part of your sunday morning with us. monterey county is always a favorite tourist destination but in addition to shopping, world-class golf and the aquarium, the area is quickly becoming a wine destination, abc7s corina rust reports on a growing industry. >> nestled in carmel valley is the this winery. the winemaker just recently completed his 29th grape harvest. he said the region has matured over time. >> in a way we are kind of the rodney dangerfield of the industry. we don't get enough respect, but it's coming. >> monterey county has been developing its wine reputation since the early 1960s. grape values now top $280 million a year. vintners say the so-called blue grand canyon located in monterey bay is one of their secrets to

success. >> you want to be careful what you grow where, but it gives us a huge array of microclimates so we can practically grow anything in salinas and carmel valley. >> the climate diversity has resulted in more than 40 varieties. and consumers are drinking what the country has to offer from chardonnay to the shira. >> this is the only winery we've been to, but even at home we drink wine from monterey. >> it produces some 40,000 acres of grapes each year and is home to 125 unique vineyards. the wineries are scattered along three stretches the 101 corridor, which goes scouth to king city, and the road south of salinas and the popular mecca of tasting opportunities along carmel valley road. there is a wide range in the size of operations. from those bottling tens of thousands of cases a year to boutique businesses, whose labels are only sold on local shelves. the number of stops you can make

in a few short miles is astound and exploding. >> we just opened up our tasting room about three weeks ago and supposedly a couple other wineries are supposed to open up pretty shortly. >> it's tough to compete with the world renown napa valley which atracts more than 4 1/2 million visitors are year. but wine enthusiasts are toasting the charm of their latest discovery. >> we have done napa a few times and we have run into the crowds and also just the price. >> the industry is capitalizing on and catering to the grape attraction. and connoisseurs are speaking up. >> you see that in the scores and the wine critics are starting to take notice and we are getting a lot of 90 plus point wines from most of the agreers in monterey county. >> it seems winemakers and wine lovers are savoring the regions sweet taste of respect. in carmel valley, abc7 news. >> i wonder what impact our

unusual weather is having on the vineyards? >> they like the variety of the cold marks and the warmer averages. this morning has been quite mild. this morning i saw one 50-degree temperatures. everyone else in the 60s and 70s. 59 in half moon bay. nice shot vulmer peak. overall a clear start and that's due to the winds. and a warmer start with pretty much the 50s. although novato and santa rosa are cool. here's our roof camera. we are looking to a sunny and nice start to the weekend with the sun coming up 7:25. setting at 5:07. look at oakland 57 san francisco 51. good morning san jose and 49 in livermore. concord 52. already with a little winds we are up to 45 in napa and a couple upper 30s. not too hard to take in novato and santa rosa. here are the winds.

this is pretty much why we are so mild. the southeast wind at the airport at 10, but a north wind from santa rosa and the easterly wind, a little gusty in concord down in the valley but we are talking about mountain view gusts to 18. but above about 1500 feet some winds are over 30 miles an hour. that's put the temperatures up anywhere from 6 to 20 degrees warmer than yesterday's readings. so we had a nice mild afternoon yesterday but we are starting out with very mild conditions. so certainly everyone in the mid-and upper 60s today with a lot of sunshine. even a few 70s possible. we hit a couple records yesterday. maybe a few more records today. still dry weather into next week. it's getting to be just the same old, same old. take a look at the pacific satellite. look how huge this ridge is. a big dominant ridge of high pressure pushing all of the cloud cover, the jet stream well into canada, and you can see the ridge right here building over much of the west coast.

with that, we are looking at temperatures as much as 10 to 15 degrees above normal. but by tomorrow those winds are bogey to shift to a more onshore component and that's because this area of high pressure will be drifting off to the east. it's a pretty good thing because we have the low relative humidity. the higher fire danger in the sierra nevada and some very gusty wind from the grapevine in southern california and those 70s which just don't team right at the coast in january. 54 yosemite. 50 tahoe. sacramento, 61 degrees today. so we will be looking at mild to warm afternoon again. in fact, half moon bay out of the 50s today, for low 60s. san francisco low 60s. a little breezy. our winds will be switching around out of the north today. so it will still be a very mild afternoon. and down by the monterey bay temperatures hitting about 70 for a couple of neighbors from salinas to watsonville. the look ahead will show it

>> frank uses waze mounted in a suction cup holder so he can keep both hands on the wheel. you should never type while driving. in fact, waze won't let you because it's dangerous and illegal. but if you are parked or a passenger, frank showed you how you can report traffic problems. >> i can say there's moderate traffic and send, and now it has put an alert there. >> those alerts help other drivers and they help abc7 news traffic give you the most accurate and detailed reports. >> so you have heavy traffic as well, and this is telling you it is on octavia streets. >> city streets and back roads have always been a challenge for reporters. traditional maps rely on underground speed sensors usually only found on freeways. so they are using waze to get the missing information. >>. >> right now the thing i'm most excited about is just taking the driver down to the street level especially if there's an incident. >> incident reports on waze are up to the second.

adalena bought the chair, they noticed a small crack in its upholstery. soon the crack grew bigger, and then another crack, and another, and then another. >> it looks like it is getting bigger. >> when i first noticed the cracking, when i see it i could feel it. some of it could be sharp. >> the couple figured no problem, they purchased this lifetime leather protection plan, along with the chair at jennifer convertibles in coma, so they contacted the store and asked to have the chair repaired or replaced under that protection plan. >> they weren't going to fix anything. that's what they told me. >> even though you bought the warranty, it doesn't cover. >> they were stunned when jennifer convertible said the lifetime guarantee does not cover this type of damage. the retailer pointed to the list of exclusions right here in the warranty. it doesn't cover fading, cracking and peeling. >> why not? i mean, that's what your salesman, jim, told us, that you

don't need to worry, for that amount of money you will pay you have nothing to worry. he even mentioned about the cracking and the peeling. >> they claimed the salesperson promised the warranty would cover all damage, regardless of exclusions. >> that's why, you know, we decided to buy the warranty. >> the couple said they wouldn't have paid $179 for the protection plan if they had known this could happen, and the warranty wouldn't help. they filed a complaint with the better business bureau, and they contacted 7 on your side. we found more than a dozen similar complaints online from other jennifer customers who were also upset their leather crack and the plan wouldn't kick in. >> after even two weeks we see response from them. >> the spokesperson said the couple should have known about the terms, saying the problem they complain of is clearly listed as an exclusion on the copy of the plan they were provided with in writing at the time of sale.
